License Terms

The following are the JspDebug end-user license terms:

JspDebug Software is confidential and copyrighted. Title to the Software and all associated intellectual property rights is retained by Desiderata Software. Licensee may not duplicate the Software other than for archival purposes only. Licensee agrees to reproduce any copyright and other proprietary right notices on any such copy.

Except as otherwise provided by law, Licensee may not modify or create derivative works of the JspDebug Software, or reverse engineer, disassemble or decompile binary portions of the Software, or otherwise attempt to derive the source code from such portions.

No right, title, or interest in or to the Software, any files generated by the Software, any trademarks, service marks, or trade names of Desiderata Software is granted under this Agreement.

The Licensee agrees to indemnify and hold harmless Desiderata Software from any claim or demand whatsover relating to or arising from the licensee's use of JspDebug.

Desiderata Software and its licensors are under no obligation to support the Software or to provide Licensee with updates or error corrections. If updates or error corrections are provided, they will be considered part of the Software, and subject to the terms of this Agreement.

SINGLE MACHINE:
The software is being provided only for use on a single machine. The software may not be used on any other machine, unless a separate valid license has been purchased for that machine. If the software is moved from one machine to another, it must be completely removed from the first machine.

NO WARRANTIES:
The software is being provided AS IS without warranties of any kind, express or implied, including but not limited to the implied warranties of merchantability or fitness for a purpose.

DISCLAIMER OF DAMAGES:
Regardless of whether any remedy set forth herein fails of its essential purpose, in no event will Desiderata Software be liable to you for any special, consequential, indirect or similar damages, including any lost profits or lost data arising out of the use or inability to use the software even if Desiderata Software has been advised of the possibility of such damages.  Some states do not allow the limitation or exclusion
of liability for incidental or consequential damages so the above limitation or exclusion may not apply
to you. In no case shall Desiderata Software's liability exceed the purchase price of the software.
